Terms of Service

These Terms of Service govern your access to and use of the framer.art website, applications, and related services.

Effective Date: August 26, 2026

These Terms of Service ("Terms") govern your access to and use of the Framer.art website, applications, and related services (collectively, the "Services"), operated by Shutter Speed Platforms LLC, a Delaware limited liability company ("Framer.art," "we," "us," or "our").

By creating an account, accessing, or using the Services, you agree to be bound by these Terms.

1. Eligibility

You must be at least 18 years old and capable of entering into a legally binding agreement to use the Services.

By using the Services, you represent and warrant that you meet these requirements.

2. Description of Services

Framer.art provides tools and services that enable photographers, artists, and creators to:

  • Create online storefronts and portfolios
  • Showcase and promote creative work
  • Sell prints and related products
  • Participate in optional sales and distribution channels
  • Use AI-powered content tools
  • Access other features and services offered by Framer.art

We may modify, suspend, or discontinue any portion of the Services at any time.

3. User Accounts

Users are responsible for:

  • Maintaining the confidentiality of account credentials
  • All activities occurring under their account
  • Providing accurate and current information

You agree not to:

  • Share account credentials
  • Impersonate another person or entity
  • Create accounts for unlawful purposes
  • Circumvent security measures

We reserve the right to suspend or terminate accounts at our discretion.

4. Artist Content Ownership

Artists retain all ownership rights in the images, photographs, artwork, text, and other content they upload to Framer.art ("Artist Content").

Nothing in these Terms transfers ownership of Artist Content to Framer.art.

5. License Granted to Framer.art

By uploading Artist Content, you grant Framer.art a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to:

  • Host
  • Store
  • Reproduce
  • Display
  • Publish
  • Distribute
  • Modify for technical purposes
  • Process
  • Transmit

your content solely for operating, maintaining, improving, promoting, and providing the Services.

This license includes the right to display content:

  • On artist storefronts
  • Within Framer.art galleries and features
  • In emails and newsletters
  • On social media
  • In promotional materials
  • In advertising and marketing campaigns

This license ends when content is permanently deleted from our systems, subject to backup retention periods and legal obligations.

6. Distribution Channels

Framer.art may offer optional distribution channels, including:

  • Framer Gallery
  • Etsy
  • Walmart Marketplace
  • Future third-party marketplaces
  • Retail and promotional channels

Participation in these channels is optional and subject to artist approval.

Opting into a channel does not guarantee that any specific item will be listed there. Selection for a given channel is at Framer.art's sole discretion and is based on a curation review of technical quality, artistic merit, and sales potential; content that is obviously AI-generated is generally not included. Inclusion is further limited by each channel's listing caps, intellectual property and marketplace policy restrictions, and listing fees.

By opting into a distribution channel, you authorize Framer.art to:

  • List your work
  • Market your work
  • Fulfill orders
  • Collect payments
  • Remit royalties
  • Manage customer service and order issues

Additional channel-specific requirements may apply.

7. Artist Storefront Sales

Artists may use Framer.art to sell products directly through their storefronts.

Artists are responsible for:

  • Product pricing
  • Product descriptions
  • Refund policies
  • Compliance with applicable laws
  • Customer communications where applicable
  • Tax obligations

Framer.art provides platform infrastructure but does not guarantee sales, traffic, revenue, or business success.

8. Payments and Payouts

Payments may be processed through providers including Stripe, Stripe Connect, and PayPal.

Artists authorize Framer.art to:

  • Collect payments
  • Deduct fees
  • Deduct production costs
  • Deduct shipping costs
  • Deduct refunds and chargebacks
  • Remit royalties and payouts

Payout timing may vary.

Framer.art may place holds on funds where reasonably necessary to prevent fraud, manage risk, or comply with legal obligations.

9. Chargebacks and Negative Balances

If a transaction results in:

  • A refund
  • A chargeback
  • Payment reversal
  • Fraud claim
  • Production loss
  • Shipping loss

Framer.art may:

  • Reduce future payouts
  • Offset future earnings
  • Create a negative account balance
  • Charge payment methods on file where permitted
  • Suspend payouts
  • Suspend account privileges
  • Pursue collection of outstanding amounts

Artists remain responsible for amounts owed to Framer.art arising from their sales activities.

10. Taxes

Artists are solely responsible for determining, reporting, and paying taxes arising from their sales and business activities.

Where required by law, Framer.art may issue tax reporting forms, including Form 1099 and similar documents.

11. Third-Party Print Fulfillment

Orders may be fulfilled through third-party print production and fulfillment providers.

Framer.art does not manufacture products directly.

Production times, shipping times, availability, and fulfillment quality may vary.

We do not guarantee uninterrupted availability of any fulfillment provider.

12. Artificial Intelligence Features

Framer.art may provide AI-powered features including:

  • Image description generation
  • Keyword generation
  • Tagging assistance
  • Search and discovery tools
  • Content organization tools

You authorize Framer.art and its service providers to process uploaded content for these purposes.

Framer.art does not use uploaded content to train its own AI models.

13. User Representations

You represent and warrant that:

  • You own or control necessary rights to uploaded content
  • Your content does not infringe third-party rights
  • Your content complies with applicable laws
  • You have authority to grant licenses described in these Terms

14. Prohibited Content and Conduct

Users may not upload, distribute, promote, or sell:

  • Copyright-infringing content
  • Trademark-infringing content
  • Illegal content
  • Fraudulent products
  • Malware or malicious code
  • Harassing content
  • Threatening content
  • Obscene content
  • Hate speech
  • Content violating third-party rights

Framer.art may remove content or terminate accounts at any time.

Framer.art respects intellectual property rights.

Copyright owners who believe content infringes their rights may submit notices to:

We may:

  • Remove allegedly infringing content
  • Restrict accounts
  • Terminate repeat infringers

Users may submit valid counter-notifications where permitted by law.

16. Subscription Plans

Framer.art may offer free and paid subscription plans.

Subscription fees, transaction fees, production fees, payout rates, and related pricing may change upon reasonable notice.

If a paid subscription expires or is canceled, the account may be downgraded to an available free plan.

Features available under paid plans may become unavailable following downgrade.

17. Reviews and Community Features

Framer.art may introduce:

  • Reviews
  • Ratings
  • Comments
  • Community tools
  • Social features

Users are responsible for content submitted through such features.

18. Account Suspension and Termination

Framer.art may suspend or terminate accounts for any reason, including:

  • Violations of these Terms
  • Illegal activity
  • Fraud
  • Abuse of the platform
  • Non-payment
  • Copyright infringement

We may remove content or restrict access without prior notice.

19. Username and Storefront Names

We reserve the right to reclaim, modify, remove, or reassign usernames, storefront names, and related identifiers that:

  • Infringe intellectual property rights
  • Impersonate others
  • Cause confusion
  • Remain inactive for extended periods

20. Availability of Services

The Services are provided on an "AS IS" and "AS AVAILABLE" basis.

We do not guarantee:

  • Continuous availability
  • Error-free operation
  • Data preservation
  • Specific performance levels
  • Sales results

Temporary interruptions may occur.

21. Disclaimer of Warranties

To the maximum extent permitted by law, Framer.art disclaims all warranties, express or implied, including:

  • Merchantability
  • Fitness for a particular purpose
  • Non-infringement
  • Availability
  • Accuracy
  • Reliability

22. Limitation of Liability

To the maximum extent permitted by law, Framer.art, Shutter Speed Platforms LLC, and their officers, directors, employees, contractors, and affiliates shall not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages.

Our aggregate liability shall not exceed the greater of:

  • $100 USD; or
  • The amount paid by you to Framer.art during the twelve (12) months preceding the event giving rise to the claim.

23. Indemnification

You agree to indemnify and hold harmless Framer.art from claims, damages, liabilities, losses, and expenses arising from:

  • Your content
  • Your sales activities
  • Your use of the Services
  • Violations of these Terms
  • Violations of applicable laws

24. Informal Resolution and Arbitration

Before filing a legal claim, both parties agree to attempt to resolve disputes informally by providing written notice.

If a dispute cannot be resolved informally within thirty (30) days, it shall be resolved through binding arbitration on an individual basis.

Class actions, class arbitrations, representative actions, and consolidated proceedings are not permitted.

Users waive the right to participate in class actions to the fullest extent permitted by law.

Either party may seek relief in small claims court where permitted.

25. Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles.

26. Business Transfers

Framer.art may transfer rights and obligations under these Terms in connection with:

  • Mergers
  • Acquisitions
  • Reorganizations
  • Asset sales
  • Financing transactions

27. Changes to These Terms

We may modify these Terms from time to time.

Material changes will become effective upon posting or other reasonable notice.

Continued use of the Services constitutes acceptance of updated Terms.
